The Valencia on the Lake Homeowners Association, Inc. is pleased to announce a Special Meeting of the Members has been scheduled for Thursday, November 9, 2023, at 6:00 p.m. Special Meetings are open session and business transacted at this meeting will be restricted to those topics stated in the agenda. The purpose of this meeting is to announce the final tally votes regarding the First Amendment to the Associations Bylaws. To comply with the Texas State Property Code 209.0056, this notice is postmarked at least ten (10) days in advance of the scheduled meeting date.
The quorum requirement for the Special Meeting is thirty percent (30%) of the lots in the property without regard to class. The approval of the First Amendment to the Valencia on the Lake Bylaw requires an affirmative vote of at least a majority of those owners present at the meeting in person or by proxy per Article 4, Section 4.9 of the Covenants, Conditions and Restrictions (“CC&R’s”). Votes cast online from the Association’s website or by e-mail shall also count for the needed quorum.
The sole topic for the upcoming Special Meeting is the First Amendment to the Associations Bylaws to address proposed revisions including a change in structure for the Board allowing for the early election of one (1) homeowner and provisions protecting Declarant rights. The documents you will need to participate in the voting process are enclosed with this notice. Additionally, you will find a summary of the proposed amendments in the ballot including a brief explanation of any impact the proposed revisions may have.
Outlined below are at least four (4) ways Members can vote, including casting your vote online and/or returning your proxy if you are unable to attend. Online voting from the Association’s website will begin on Monday, October 2, 2023, at 12:00 p.m. and will close on Wednesday, November 8, 2023, at 5:00 p.m. Please be advised, no online voting or ballots submitted after the deadline may be accepted.
Ways you can vote:
1. You can cast your vote electronically from your Association’s Website.
2. Email your Ballot or Proxy to Abarnes@essexhoa.com
3. Fax your Ballot or Proxy to: (469) 342-8205 ATTN: Ashton Barnes
4. Submit your Ballot or Proxy through U.S. Mail to the address located in the footer, ATTN: Ashton Barnes. (Please be sure you mail your Ballot or Proxy allowing plenty of time for the mail to reach us.)
We look forward to you joining us on Thursday, November 9, 2023, at 6:00 p.m. All documentation enclosed will be posted to the Association’s website and available for viewing, downloading or print. Only the Owner of Record or the proxy holder may vote and only one (1) vote per home/lot is allowed. It is very important that all documents are returned to the managing agent by or before the deadline mentioned above. Results of the vote will be announced in the Special Meeting of the Members.
